These Terms of Use ("Terms") apply to User access to, and use of, the Flipfares.com-branded websites and Website (collectively, the "web portal & mobile apps") made available by Flipfares.com. The web portal & mobile apps is offered to benefit customers in obtaining travel information, services, and/or making valid reservations. Flipfares.com primarily sells international flight tickets. We are different from any traditional travel websites in that, once a customer searches flight tickets he/she will have option to (a) request flipfare.com for the route/price (b) once request received, agents will re-price the ticket with lower fare or best price. (c) Agents will quote the lowest price and are bound to the fare which is quoted by them on our b2b system.
As a prerequisite of User use of the web portal & mobile apps, User agree that (i) User are at least eighteen years of age; (ii) User have the right and authority to enter into a legal obligation; (iii) User will abide by the terms; (iv) User will only use the web portal & mobile apps to make valid reservations for User or for another person User have informed about these Terms; (vi) all information given by User is true, accurate, current and complete; and (vii) will supervise and be completely responsible for any use of User account.
All flipfare.com(web portal and mobile apps) data and information is proprietary to us or our suppliers and providers. This includes fares, and/or obtainability of travel, and our software used to provide this information. It is understood User may make copies of Users’ travel itinerary booked through our site, and User agrees not to modify, copy, distribute, transmit, reproduce, publish, create plagiaristic works from, or sell any information, software, or data obtained from our web portal & mobile apps. Some third-party providers offering certain activities or services may require User to sign their liability waiver in advance of participating in the service and/or activity they offer. If User does not sign User understand supplier's rules and restrictions may result in cancellation of User reservation and/or in User being denied access to the chosen travel services and forfeiture of any monies. Please read these additional terms and conditions carefully.
Flipfares.com has no control over airline fares and prices hence, airlines and other travel suppliers may change their prices without notice. Flipfares.com can only guarantee prices when the purchase has been completed and the tickets have been issued. We reserve the right to cancel User booking if full payment is not received.

Fraud: If User booking or account shows signs of dishonesty, we retain the right to cancel any bookings associated with User account, and close any accounts. We have the right to close User account and/or restrict User access to the web portal and mobile apps at our sole discretion. If User has been advised by us that User Account is closed and are prohibited from using the web portal & mobile apps, any ensuing access or use by User shall be unauthorized and unlawful.
Flipfares.com is not privy to foreign admission requirements, it is User responsibility to obtain this knowledge and make sure User travel documents are adequate. It is to User best interest to review and have information regarding travel to international destinations:
Information: The information, we publish on our web portal and mobile apps may at times have errors and inaccuracies, such as pricing errors. Flipfares.com disclaims liability for any errors relating to the information online on our web portal and mobile apps. In addition, we withhold the right to correct any pricing errors, and offer the prospect to keep User pending reservation at the correct price. Flipfare also gives User the option to cancel User reservation without penalty.
Viruses: We at flipfares.com and affiliate suppliers do not warrant any information, software, products, and services are free of viruses or other harmful components.
Suppliers: The third party suppliers providing travel or other services on the flipfares.com web portal and mobile apps are independent contractors and not agents or employees of Flipfares.com. Therefore we are not liable for any errors, omissions, warranties, or negligence from third party suppliers. Flipfares.com accepts no liability for any Flipfares.com has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, or other causes beyond their direct control, and they have no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority.
Liability: Limited Liability, if found liable for any loss or damage despite the disclaimer, then Flipfares.com and/or their third party suppliers will in not pay more than (a) the service fees User paid to Flipfares.com in connection with the booking transaction(s) on the web portal & mobile apps, or (b) One-Hundred Dollars (US$100.00).
User agree to indemnify and Hold Harmless Flipfares.com, and/or their respective suppliers and any of their agents from any claims, losses, damages, or other costs or expenses of any kind or nature including reasonable legal and accounting fees, brought by third parties as a result of:
Any software available from the Services is copyrighted work by Flipfares.com and/or our affiliate suppliers. We may require User to sign an End User License Agreement User may not install or use our proprietary software unless User first agree to the License Agreement terms. If we make available software without the License agreement we allow User, the user, and a limited, non-exclusive, nontransferable license to download, install and use the Software. For legal purposes all Software is owned by flipfares.com and/or our affiliate suppliers and is protected by copyright laws. Reproduction and distribution of our Software is prohibited, and if you violate these terms it may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. As further described in Flipfares.com Privacy Policy, the Services will automatically relocate a small amount of data for informational purposes such as how User use the Services, which content User access, and technical errors or problems which the Services may encounter while being used by User. Using the Services, implies your consent to the collection of this information.
The web portal & mobile apps may contain hyperlinks to websites operated by parties other than Flipfares.com. Our inclusion of hyperlinks to such websites does not imply an endorsement of such websites. Such hyperlinks are provided for User reference only. We do not control these sites as such; it is up to User to take measures to ensure that whatever links User select is free of such items as viruses, and defects and other items of a destructive nature.
Currency Converters are available online. We do not verify the rates as accurate, and the actual rates may vary. Flipfares.com does not endorse the use of this information for any purpose other than User personal use; therefore, we suggest User check the date on the currency converter feature for the day that currency was last updated.
Be aware that most banks and credit card companies charge additional fees for international transactions. The currency exchange rate and foreign transaction fee is determined by User bank on the day that they process the transaction. If User has any questions about these fees and/or the exchange rate, please contact User bank.
All content encountered while using our Services is considered intellectual and proprietary property of Flipfares.com, and are protected by U.S. and international copyright and trademark laws. This includes logos, designs, text, graphics, pictures, information, data, software, sound files, other files.
As a user of our web portal & mobile apps or Services User is granted a limited, nonexclusive, non-sublicenseable consent to access and use the Services and Content. This consent does not include resale of the content, the distribution or modification of the content. It is prohibited to use data mining, robots or any other methods to extract proprietary information. Any use of the Services other than for their intended purposes is strictly prohibited and will terminate the rights of the user. Our consent for User to use our services and content is revocable at any time, with or without notice.
In accordance with the Digital Millennium Copyright Act ("DMCA") and other laws, we have a policy of terminating the account of users who are deemed to be repeat infringers, who infringe any intellectual property rights of others.
If User believe that User account or the account of another user has been infringed upon User may supply us with any information sufficient for us to verify the accusation.
If User believes that anything on the Services infringes any copyright User own, User may file a notice of such infringement at the address below. Be aware that if User knowingly make any false misrepresentation in User notification, User will be liable for any damages, including costs and attorneys' fees, incurred by us or the alleged infringer as the result of misrepresentation. We suggest that User seek legal counsel before filing a notice. Any misrepresentations in User notice regarding whether content or activity is infringing may expose User to liability for damages (including costs and attorneys' fees).

Patent Notices: Patents owned by a Flipfares.com may apply to the Services and to the features and services accessible through the Services.
If the circumstance a dispute does arise between the User and flipfares.com, we request User to contact our customer service department in order to provide User with an effective means of resolving the dispute quickly. Accordingly, the Parties agree that we shall resolve any action, claim or controversy at law or equity (a "Claim") that arises out of User’s use of the Services. User has the option to submit a claim within two (2) years to the state or federal courts located in the Jurisdiction of Texas.
Mandatory Arbitration: Any Claim where the total amount in controversy is less than $10,000 will be resolved through binding arbitration initiated through the American Arbitration Association ("AAA"). The AAA Rules are available online at www.adr.org or by calling the AAA at 1-800-778-7879.
Waiver: User understands and agrees that, by entering into these terms, the User and flipfares.com are each waiving the right to a trial by jury or to participate in a class action with respect to the claims covered by this mandatory arbitration provision.
Inappropriately Filed Claims: All Claims User bring against us must be resolved in accordance with Flipfares.com’s "Resolution of Disputes" section. All Claims filed or brought divergent to this "Resolution of Disputes" section will be considered Inappropriately filed and void and furthermore, we may recover attorneys' fees and costs provided that we have notified User in writing of the Inappropriately filed Claim, and User has failed to promptly withdraw the Claim. Insomuch, if we take action to enforce these Terms, we will be entitled to recover from User attorney's fees and any costs of litigation, in addition to any other relief, to which we may be entitled.
Injunctive Relief: User agree that a violation of any of these Terms will cause irreparable damage to us and furthermore User agrees that we shall be entitled to seek an injunction from any court to restrain such violation by User
User, hereinafter referred to as the (“User”) must be at least 18 years of age and possess the legal authority to enter into this agreement and to use the Site in accordance with all Terms & Conditions herein. The “User” is responsible for any bookings and travel reservations made by the User or by any person who has been granted authority. User guarantees all information given is accurate. Furthermore, the User warrants that the traveler is not an unaccompanied minor.
The Booking terms of including but not limited to price, availability and/or dates of travel are not guaranteed until the booking is completed between User and the Travel Supplier and a ticket has been issued and/or a reservation has been made and confirmed by the Travel Supplier. Once the ticket is issued User can only cancel or change the details (such as names or destinations) of User Booking at our sole discretion and in accordance with these Terms & Conditions.
Booking process may include a mandatory credit card authorization. After the booking request confirmation email sent with 'Ticketing Pending' status, final E-Ticket will be issued within the next 2 hours with a email confirmation sent to user with 'Ticketed' status and E-Ticket numbers. In which case if user has not received any final E-Ticket and/or a reservation within 2 hours, It is user responsibility to either email or call agency and confirm final E-Ticket. Flipfares.com is not responsible for the ticket not issued and/or a reservation has not been made and not-confirmed by the travel supplier of the above.
Neither Flipfares.com nor its affiliates accept any responsibility, and User will not be entitled to any refunds whatsoever, if User is denied boarding, delayed or deported due to non-fulfillment of the above. We reserve the right to change the Booking process at any time, with changes automatically taking effect from the date such changes are posted on the Site.
Pricing, Taxes/Fees, and Payment: Our combined total prices includes, taxes and fees pertinent to airfare, hotel accommodation, this may also include fuel surcharges, security, baggage, seat reservation, hotel incidentals, and other applicable service charges may apply which will be charged by the Third party Supplier at time of check-in. User is solely responsible for any such additional charges due and if User has any questions about such charges, please contact the Travel Supplier directly.
Payment must be made in full with a valid credit or debit card at the time of Booking. Flipfares.com accepts all major credit or debit cards with a verifiable billing address. User hereby authorize Flipfares.com and its authorized third party to process the charge to the credit or debit card User provide to us for the total amount of User Booking. We are not responsible for any transaction that is declined based upon a credit/debit card that is declined by the Users bank or credit card Company for any reason
All of our airline tickets, hotels, pre-paid car rentals, vacation packages and service fees are non-refundable. If you have purchased Trip protection insurance and travel has not commenced you may be entitled to a refund if certain conditions are met. User must call our customer service center to cancel. Once User has provided our customer service agent with User cancellation request, we will then send User an email notification that User request has been received. This email provides User with an acknowledgement of the request and provides a tracking number. Refunds are based on third party supplier’s rules and regulations. Our services fees associated with the original travel reservation are not refundable. All refund requests are processed in a sequential format. We are unable to provide a specific time line for how long it may take for this requested refund to be processed. Generally, all suppliers will charge a penalty for refund. Apart from the airlines and other suppliers refund penalties, Flipfares.com will charge a fee for processing. All refund fees are charged on a per ticket per person basis.
Flipfares.com or issuing Agency is not responsible for flight changes, visa requirements, transit airport restrictions, penalties, non-refundable tickets and baggage allowance changes. Passenger responsibility to check prior to booking tickets and travel. Flipfares service fee in addition to Airline Cancellation and airline change fee.
Airlines may change penalties and change fees without notice. Please contact travel agent for more details.
Cancellations or refund due to emergency or medical reasons
on any cancellations with medical reasons will be forwarded to airlines as submitted by traveler. Flipfares.com is not responsible with airline decisions or reply. Flipfares.com and it's providers will serve only as an agency between customer or traveler and airlines. customer or traveler can directly contact airlines in case of emergency or cancellations due to emergency or require refund due to any other condition. Flipfares.com is not liable for any charges or cancellation refund in any itinerary or flight ticket or bookings.
All Airlines have differing rules and policies regarding schedule changes, which are beyond our control. Due to the operational needs of each airline, changes are often made to the flights that they are currently operating. Often these changes are a prediction of travel needs for a future dates but can also reflect same day changes. Types of changes could be: flight number changes, time changes, routing, date changes and or cancellations. Cancellations include when an airline has stopped or temporarily canceled service to certain cities, or stopped service on certain days of the week. Airline cancellations may occur due to peak travel seasons; airport terminal or gate changes; fuel prices; civil unrest; force majeure; and or bankruptcy. Flipfares.com does not assume any liability whatsoever for cancelled flights, flights that are missed, or flights not connecting due to any scheduled changes made by the airlines.
Please reconfirm your flights with the airline 3 (three) days prior to each travel date. Airlines may change the flight or cancel the flight without notice, passenger(s) are responsible to recheck with airlines on flight changes and itineraries.
All visa requirements Passengers responsibility. Passenger(s) are responsible for verifying that their Passport is valid 6 (six) months beyond the scheduled return date, as well as any transit or visa requirements for each destination.
Airline delays and changes
Flipfares.com is not responsible for any airline delays and transfer delays with itineraries. Traveler or customer should directly contact airlines for any such incidents or occurrences and resolve directly with airlines. flipfares.com is not responsible for changes required for any delays or changes in itinerary.
Excess Baggage: If User has excess baggage, User will have to pay excess baggage fee collected by each airline. Airlines may charge fees for the first bag checked-in; we recommend traveling light to reduce these costs. To find the baggage fees for each airline, please visit airline’s online website.
Baggage fees per checked bag range from $15 up to $200 or more depending on the size and weight of the bag. These fees are paid directly to airline.
Policy on connecting flights: When there are two different airlines involved for connecting flights, User may have to reclaim User bags and check-in again. If User has excess baggage, User will have to pay the excess baggage fee again by each airline. To locate the fees on baggage check-in by airlines, please visit the airline’s online website.
Baggage Liability: For flights within the U.S., federal rules require any limit on an airline's baggage liability to be at least $3,300 per passenger. For international travel (including domestic portions of international journeys) different liability limitations apply to the loss, delay, or damage to baggage Airlines assume no liability for fragile or perishable articles. Agent fee of $50 for changes (excluding airline fees+fare difference) and $100.00 per ticket on cancellations(excluding airline charges) is charged. Name changes are not allowed. Getmax membership is required to avail Stressfree cancellation program. Stressfree cancellations are allowed on specific airlines and routes. please contact agent for more information. a minimum cancellation fees of $25 per traveler is charged for cancellations in less than 12 hours using the Stressfree cancellation program.
Stressfree cancellation is allowed for one booking per customer in 30(thirty) days. Flipfares.com reserves the right to charge airline cancellation fees and penalties after first booking stressfree cancellation.
Stressfree cancellations are limited to specific routes, airlines and subject to airline rules and regulations. some non-refundable tickets may not have Stressfree cancellation available. please contact agent for more information.
All issued tickets are non-refundable and non-cancellable. if allowed by airlines, issued tickets will pertain cancellation fees, penalties, date change fees and other fees as per airline rules and regulations.
Stressfree cancellation is limited to certain airlines and routes. airlines does not allow multiple cancellations or void bookings. cancellations or booking voids may be limited to one cancellation per customer/traveler in 7(seven) days or less than 30(thirty) days. Flipfares.com will notify customer/traveler in case of airline limitation to issue new booking after previous booking cancellations on the same airline or different airlines or multiple airlines.
Flipfares.com reserves the right to reject booking transaction to user/customer/traveler. Flipfares.com confirmed itinerary is invalid if any user booking transactions is cancelled/void or booking request is cancelled/closed as per booking cancel or void policy. It is user responsibility to either email or call agency and confirm final E-Ticket. Flipfares.com is not responsible for the ticket not issued and/or a reservation has not been made and not-confirmed by the travel supplier of the above and as per booking cancel or void policy.
Flipfares.com reserves the right to reject booking transaction to user/customer/traveler in case of multiple booking cancellation in a span of less than 30days.
Flipfares.com validates customer details and verifies booking information with multiple sources but not limited to banks, credit card companies and trusted third party sources. Flipfares.com reserves the right to reject booking transaction to user/customer/traveler on incomplete and unverified booking transactions.
As part of the booking process, Flipfares.com verifies customer information before issuing of the final E-Ticket. Flipfares.com ticketing agents may call the customer for verification of customer information or passenger information or credit card information(requests may include but not limited to passport copy, credit card copy, drivers license and any other valid id). once verified and validated, agents may also send a credit card authorization e-signature request as per airlines or credit card processing rules. As per airline rules and regulations - PNR# and confirmation# are void and the booking request is voided, IF THERE IS NO RESPONSE OR NO REPLY FROM CUSTOMER WITHIN 24 (TWENTY FOUR) HOURS WITH ANY/ALL INFORMATION REQUESTED. Flipfares.com reserves the right to reject booking transaction to user/customer/traveler on incomplete and unverified booking transactions.
Flipfares.com takes fraud prevention seriously. Flipfares.com ticketing agents work with banks and credit card companies to protect customer security and fraud prevention. Flipfares.com ticketing agents reserves the right to request information as required. Flipfares.com ticketing agents reserves the right to reject booking transaction to user/customer/traveler on incomplete and unverified booking transactions. Flipfares.com strictly follows travel industry and financial institutions fraud prevention rules.
Text message services are offered for Getmax members. PNR services with limited text will be notified to customer using the mobile number given or registered with getmax account. Text messaging services are limited and may change without notice. Flipfares.com is not responsible for mobile carrier charges on messages sent to customer mobile.

If the passenger's journey involves an ultimate destination or stop in a country other than the country of departure the Warsaw Convention or the Montreal Convention may be applicable and the applicable Convention governs and in most cases limits the liability of carriers for death or personal injury, delay, and in respect of loss of or damage to baggage. As used in this contract "ticket" means the passenger ticket and baggage check, of which these conditions and the notices form part; "carriage" is equivalent to "transportation"; "carrier" means any air carrier that carries or undertakes to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage; "electronic ticket" means the Itinerary/Receipt issued by or on behalf of Carrier, the Electronic Coupons and, if applicable, a boarding document; and "SDR" means the Special Drawing Right as defined by the International Monetary Fund (as of April 2004, 1 SDR ~ $1.50). "Warsaw Convention" means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th October 1929, and/or that Convention as amended at The Hague, 28th September 1955, and/or that Convention as amended at Montreal, 25th September 1975, and/or that Convention as amended at Montreal, 25th September 1975, whichever may be applicable. "Montreal Convention" means the Convention for the Unification of Certain Rules for International Carriage by Air signed at Montreal, 28th May 1999.
Carriage hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention or the Montreal Convention unless such carriage is not "international carriage" as defined by the applicable Convention.
To the extent not in conflict with the foregoing carriage and other services performed by each carrier are subject to: (I) provisions contained in this ticket, (II) applicable tariffs, (III) carrier's conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier) except in transportation between a place in the United States or Canada and any place outside thereof to which tariffs in force in those countries apply.
Carrier's name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier's tariffs, conditions of carriage, regulations or timetables; carrier's address shall be the airport of departure shown opposite the first abbreviation of carrier's name in the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carrier's timetables as scheduled stopping places on the passenger's route; carriage to be performed hereunder by several successive carriers is regarded as a single operation.
A carrier issuing a ticket for carriage over the lines of another carrier does so only as its Agent.
Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants and representatives.
Checked baggage will be delivered to bearer of the baggage check. In case of damage to baggage moving in international transportation complaint must be made in writing to carrier forthwith after discovery of damage and, at the latest, within seven days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered. See tariffs or conditions of carriage regarding non-international transportation.
This ticket is good for carriage for one year from date of issue, except as otherwise provided in this ticket, in carrier's tariffs, conditions of carriage, or related regulations. The fare for carriage hereunder is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid.
Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetables or elsewhere are not guaranteed and form no part of this contract. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections.
Passenger shall comply with Government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by carrier or, if no time is fixed, early enough to complete departure procedures.
No agent, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.
Presentation of a valid ticket entitles the passenger to transportation only between the points and via the routing designated thereon. Flight coupons will be honored only in the order in which they were issued.
Tickets are not transferable to others.
A reservation is subject to cancellation by the carrier if the passenger is not available for boarding at the loading gate at least 10 minutes prior to scheduled departure for flights between U.S. points or up to 30 minutes for all other travel.
Failure to occupy reserved space may result in the carrier canceling continuing, connecting, or returning space reserved by the passenger.
CARRIER RESERVES THE RIGHT TO REFUSE CARRIAGE TO ANY PERSON WHO HAS ACQUIRED A TICKET IN VIOLATION OF APPLICABLE LAW OR CARRIER'S TARIFFS, RULES OR REGULATIONS
Liability for loss, delay, or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. For international travel (including domestic portions of international journeys) to which the Warsaw Convention applies the liability limit is approximately $9.07 per pound ($20 per kilogram) for checked baggage and $400 per passenger for unchecked baggage. For international travel (including domestic portions of international journeys) to which the Montreal Convention applies the liability limit is approximately $1500 (1000 SDR) per passenger for all baggage. For travel wholly between U.S. points federal rules require any limit on an airline's baggage liability to be at least $3300 per passenger. Excess valuation may be declared on certain types of articles. Some carriers assume no liability for fragile, valuable or perishable articles. Further information may be obtained from the carrier.
Airline flights may be overbooked, and there is a slight chance that a seat will not be available on a flight for which a person has a confirmed reservation. If the flight is overbooked, no one will be denied a seat until airline personnel first ask for volunteers willing to give up their reservation in exchange for a payment of the airline's choosing. If there are not enough volunteers the airline will deny boarding to other persons in accordance with its particular boarding priority. With few exceptions persons denied boarding involuntarily are entitled to compensation. The complete rules for the payment of compensation and each airline's boarding priorities are available at all airport ticket counters and boarding locations. Some airlines do not apply these consumer protections to travel from some foreign countries, although other consumer protections may be available. Check with the airline or your travel agent.
For all flights departing from the European Union and all flights to the European Union if on an European operating carrier, if you are denied boarding or you flight is canceled or delayed for at least two hours, ask at the check-in counter or boarding date for the text stating your rights, particularly with regard to compensation and assistance. Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of the Warsaw Convention or the Montreal Convention may be applicable to the entire journey, including any portion entirely within the country of origin or destination.
For such passengers to whom the Warsaw Convention applies on a journey to, from, or with an agreed stopping place in the United States of America, the Convention and special contracts of carriage and/or applicable tariffs provide that the liability of certain carriers for death of or personal injury to passengers is limited in most cases to proven damages not to exceed $75,000 per passenger, and that liability up to such limit shall not depend on negligence on the part of the carrier. The limit of liability of $75,000 above is inclusive of legal fees and costs except that in case of a claim brought in a state where provision is made for separate award of legal fees and costs, the limit shall be the sum of $58,000 exclusive of legal fees and costs. The names of carriers that are parties to such special contracts and/or applicable tariffs are available at all ticket offices of such carriers and may be examined on request. In addition, some carriers have adopted a limit of approximately $150,000 (100,000 SDR) per passenger, pursuant to the U.S.Department of Transportation Order 97-1-2 (10th January 1997). For such passengers traveling by a carrier not a party to such special contracts and/or applicable tariffs or on a journey not to, from, or having an agreed stopping place in the United States of America, liability of the carrier for death or personal injury to passengers is limited in most cases to approximately $10,000 or $20,000.
For such passengers to whom the Montreal Convention applies, the Convention provides that the liability of carriers for death or personal injury to passengers is approximately $150,000 (100,000 SDR) per passenger, and that liability up to such limit shall not depend on negligence on the part of the carrier. In addition, the liability of carriers for death or personal injury to passengers is unlimited if death or personal injury was due to the negligence or other wrongful act or omission of the carrier or its servants or agents. The Convention also provides that the liability of carriers for delay is limited in most cases to proven damages not to exceed $6,225 (4150 SDR) per passenger.
Additional protection can usually be obtained by reserving insurance from a private company. Such insurance is not affected by any limitation of the carrier's liability under the Warsaw Convention, special contracts of carriage and/or applicable tariffs, or the Montreal Convention. You agree to abide by the terms or conditions of the booking imposed by any supplier with whom you elect to deal. A supplier that is an air carrier is required to make available to the public the terms of its contract of carriage pursuant to Title 14, Part 253 of the Code of Federal Regulations, and we make available the fare rules for all air carrier tickets prior to booking. The circumvention of an air carrier's rules, including practices such as back-to-backticketing (booking two or more tickets with overlapping travel dates in order to circumvent minimum stay requirements) and hidden-city ticketing (booking tickets including segments which the booker does not intend to use in order to circumvent an air carrier's pricing structure), is prohibited by many air carriers. The use of prohibited ticketing practices may result in the air carrier taking actions including the cancellation of the ticket, denied boarding, revocation of frequent flier miles and other benefits, additional charges to the booker's credit card, additional charges collected at the airport, or future invoicing. You are responsible for ensuring that your bookings abide by the terms or conditions of booking imposed by any supplier with whom you elect to deal, including terms or conditions of booking set forth in an air carrier's fare rules or contract of carriage.
